Shimerith

1. Acceptance of Terms

By creating an account or using Shimerith, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Eligibility

You must be at least 13 years old to use Shimerith. If you are between 13 and 17, you represent that you have your parent or guardian's permission to use the service. Users under 18 cannot access mature or explicit content. Paid subscriptions require you to be at least 18 years old or have a parent or guardian complete the purchase.

3. Intellectual Property & Content Ownership

Shimerith does not claim ownership, license, or any rights to your manuscripts, chapters, or any creative content you upload.

You retain full ownership of all content you create and upload.
By uploading content, you grant Shimerith a limited, non-exclusive license solely to display your content to invited beta readers and to process it through AI analysis features you explicitly request.
This license terminates when you delete your content or account.
Feedback provided by beta readers is owned by the reader who created it, with a license for the author to view and use it for revision purposes.

4. Acceptable Use

You agree not to:

Upload content you do not own or have the right to share.
Use the platform to distribute illegal, abusive, or harmful content.
Harass, threaten, or intimidate other users.
Attempt to circumvent security measures, rate limits, or usage restrictions.
Use automated tools or bots to access the service without authorization.
Share or redistribute manuscripts you have access to as a beta reader without the author's explicit permission.
Upload content that exploits minors in any way.

5. Content Moderation

Shimerith includes content rating and warning systems to help users manage their exposure to sensitive material.

Authors are responsible for accurately rating their manuscripts and applying appropriate content warnings.
Users may report content that violates these terms or is inaccurately rated.
We reserve the right to remove content or suspend accounts that violate these terms, with or without notice.
Mature and explicit content is restricted to users who are 18 or older and have opted in.

6. AI Analysis Features

AI analysis is provided as a supplemental tool and should not be relied upon as the sole source of feedback.
When you use AI features, your text is sent to third-party providers (Anthropic, OpenAI) for processing.
AI-generated feedback represents automated analysis and may contain inaccuracies.
Usage is subject to monthly limits based on your subscription plan, unless you provide your own API key.

7. Subscriptions & Payments

Paid plans are billed monthly through Stripe.
You can cancel your subscription at any time. Access continues until the end of the current billing period.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
Refunds are handled on a case-by-case basis. Contact us if you believe you were charged in error.

8. Account Termination

You may delete your account at any time through Settings. All data will be permanently removed.
We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or are used for unauthorized purposes.
Upon termination, your content and data will be deleted according to our Privacy Policy.

9. Limitation of Liability

Shimerith is provided "as is" without warranties of any kind, either express or implied.

We are not liable for any loss of data, manuscripts, or creative work. You are responsible for maintaining backups of your content.
We are not responsible for the quality, accuracy, or appropriateness of feedback provided by beta readers or AI analysis.
Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Shimerith and its operators from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes through email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated terms.
